Compulsory execution of judicial rulings is the legal instrument that confers prestige upon rights, transforming judgments from mere texts written by the judiciary into a tangible reality. It is the procedure initiated by the public authority under judicial supervision, at the request of a creditor possessing an enforceable title. Its purpose is to extract the right established by the ruling from the debtor’s assets by force whenever they refrain from voluntary compliance.
First: The Concept of Execution Disputes
Execution disputes are legal litigations born from the womb of compulsory execution procedures and revolve within its orbit. They arise upon the commencement of execution and are considered a legal contingency thereof. These disputes primarily center on the fulfillment of formal and substantive conditions required to proceed with execution, or the validity of those procedures and their compliance with the letter of the law.
Second: The Nature of Judgments Rendered in Disputes
A judgment issued in an execution dispute is nothing more than an adjudication on the legality of the procedure, where the res judicata effect of the judgment is confined to:

Determining the permissibility or impermissibility of execution.

Ruling on the validity or nullity of execution procedures.

Ordering the temporary stay or continuation of execution.

Limiting the scope of execution or disregarding it.
These disputes are initiated either during the execution process or after its completion, and they may take one of two forms:

Substantive Disputes: These aim to resolve the conflict regarding the core of the right to be executed or its legitimacy, resulting in a definitive substantive judgment.

Summary Disputes (Execution Petitions/Obstacles): Where the litigant seeks a temporary precautionary measure that does not touch the essence of the right, but rather aims to protect it until the dispute is resolved.
Third: The Subject-Matter Jurisdiction of the Execution Judge
It is an established legal principle that execution litigation does not transfer the subject matter of the dispute—already settled by the original ruling—to the execution court; the finality of the judgment to be executed remains intact.
Under Article (207) of the Civil Procedure Law, the legislator has restricted jurisdiction exclusively to the Execution Judge (with the exception of real estate ownership claims). The judge is tasked with supervising the enforcement of execution titles and adjudicating all related disputes—whether substantive or summary—on an urgent basis, while being empowered to issue the judgments, decisions, and orders necessary to ensure the enforcement of the law.
