The UAE Legislative Policy on Combating Narcotic Drugs and Psychotropic Substances ⚖️
Share
Combating narcotic drugs and protecting society from their harmful effects constitute one of the fundamental pillars of the criminal and security policy of the United Arab Emirates. In light of the growing challenges and increasingly sophisticated methods of trafficking and promoting these dangerous substances, the UAE legislator has continuously updated its legal framework, most notably through the enactment of Federal Decree-Law No. 30 of 2021 on Combating Narcotic Drugs and Psychotropic Substances.
This legislation establishes a carefully balanced approach that combines strict deterrence against traffickers and dealers with therapeutic and rehabilitative justice for drug users.
First: The Legislative Distinction Between Drug Use and Drug Trafficking
The modern legal philosophy adopted by the UAE draws a clear distinction between individuals who fall victim to addiction and those who intentionally seek to undermine society through the importation, trafficking, and distribution of narcotic substances.
Drug Users: A Therapeutic and Rehabilitative Approach
The UAE legislator adopts a corrective and rehabilitative approach toward first-time drug users. The law grants courts the authority, under specific conditions, to order the placement of offenders in rehabilitation and treatment facilities instead of imposing custodial sentences.
Furthermore, Article 89 of the law provides that criminal proceedings shall not be initiated against a drug user if the individual, their spouse, or a relative up to the second degree voluntarily approaches an addiction treatment center or the Public Prosecution seeking treatment.
Drug Traffickers and Dealers: A Strict Deterrent Approach
Conversely, the legislator has imposed severe penalties for crimes involving the importation, exportation, manufacturing, trafficking, and distribution of narcotic substances. These penalties may extend to life imprisonment or the death penalty, particularly where the offense is committed for the purpose of trafficking, within places of worship or educational institutions, or by individuals entrusted with combating such crimes.
Second: Preventive Measures and Ancillary Penalties
The UAE’s criminal policy extends beyond principal penalties such as imprisonment and fines to include preventive measures designed to prevent reoffending.
Deportation of Foreign Nationals
The law establishes clear regulations concerning the deportation of foreign nationals convicted in drug-related cases. In certain drug-use cases, courts retain discretionary authority to determine whether deportation is appropriate, taking into account humanitarian and social considerations.
Confiscation of Assets
All proceeds and assets derived from drug-related offenses are subject to confiscation, in addition to any tools, equipment, or means of transportation used in committing the crime.
Financial Freezing Orders and Travel Bans
The Public Prosecution possesses broad powers to freeze bank accounts and impose travel bans on suspects involved in trafficking and distribution cases, thereby disrupting the financial networks supporting criminal organizations.
Third: Regulatory and Preventive Measures
UAE legislation is not solely punitive in nature. It also establishes strict controls over chemical substances used in the manufacture of pharmaceutical products and psychotropic substances, commonly known as chemical precursors, to prevent their diversion into illegal markets.
Health authorities, in cooperation with security agencies and customs authorities, continuously update the schedules of narcotic and psychotropic substances to address emerging synthetic drugs and newly developed substances, including methamphetamine (“Shabu”) and Captagon.
Conclusion
The legal framework of the United Arab Emirates demonstrates a highly effective approach to combating drug-related crimes by combining legislative and security measures aimed at protecting society and national borders with a humanitarian dimension that offers treatment, rehabilitation, and reintegration opportunities for drug users.
Confronting this social threat requires comprehensive legal awareness that begins within the family and extends to all institutions of the state, ensuring that the UAE remains a safe and secure society.
