Evidence of the legitimacy of the will
A will is established by the Qur’an and the Sunnah. God said: “After a bequest he has made a bequest or a debt” [An-Nisa: 11], and the Prophet said: “It is not the right of a person who has something to bequeath to him to spend two nights unless his will is written with him” (Sahih Al-Bukhari: The Book of Wills, Chapter on Wills The Prophet said: A man’s will is written.)
On the authority of Abdullah bin Omar, may God be pleased with them both, that the Messenger of God, may God’s prayers and peace be upon him, said: “It is not the right of a Muslim man who has something to bequeath to him to spend two nights unless his will is written with him.” Narrated by Al-Bukhari.
